Divorce legal advice? I recently seperated from my wife. We live and run a business from the same property. After one week my wife moved her boyfriend in and he is now living in our property with our kids and is helping my wife run the business. I am now homeless and my wife is refusing to give me any money from the business. Also i bought a car last year and took out a personal loan in my name for £10,000. I have no money to meet the monthly repayments and because of this my wife sold the car and used the money to buy a newer one. Is this legal? I registered the car in my wifes name. I fear as since the loan was not a personal loan and not borrowed on the car that i am powerless to do anything. To add insult to injury my wife is refusing me access to my kids. Even if my wife admits adultery i was told that this does not really matter as far as UK law is concerned
Legal advice for divorce.. He is too nice!! Help? A friend of mine is the sweetest guy and going through a divorce, good since she cheated on him 7 times! The are done and somewhat get along. 3 kids in the middle and she has all the control gets 2600 a month from him, barley works, and then asks for more money when has none. He takes care of his kids very well ages 10,7 and 5 all want to live with him she says no. He has asked many lawyers and legal services advice since she cant be proven to be un-fit he has no chance in taking legal and psychical custody. He asks her all the time let me take them they want to live with me and there about 3 hours apart so when he isn't at work he's with the kids. Dont know what I can say or do to help him out and hope there is something of legality he can do to have his kids happy and let her figure herself out. She has anxiety and takes medication more than needed and don't know if that could help his case, but I do know he is getting walked on bad and in attempt to do anything for his kids.
Stay at home mom needs legal advice on divorce proceedings: Where do I begin? I am a stay at home mom who has not worked outside the home since our three children were born. My marriage is on the rocks and my husband has become increasingly verbally abusive and is threatening me w/ finances as a way to control me. I feel divorce at this time is my only option. Need legal advice for divorce / custody case? State of Colorado, divorce has been going on for almost 6 months. Opposing council is unethical, and has pulled out every dirty trick possible. He is attempting to over-turn protection order in place, and constantly creates frivolous issues for my attorney to drain my retainer. Nearly $40k dollars later, I am realizing my attorney is not a match for this- he is always playing defensive and gets mauled by opposing council. I need a new attorney but now do not have the money for a retainer. Because my spouse has unlimited finances, I have been told I won't qualify for legal aid, and have been advised by many that legal aid/pro bono attorneys often do not put in the effort necessary to win a case. I am desperate. My ex, even with his domestic abuse history, has been awarded more custody than me of our 2 year old son and while the judge reminded me this is only temporary, I have no idea where to turn. To answer the questions below- he was awarded more custody than me based on the CFI's report which denied and/or greatly minimized the domestic abuse, regardless of evidence. The CFI then suggested there was no reason a 50/50 custody split should not be inplemented, however, since my spouse's work hours are so demanding, he insisted that more nights should be awarded to him to compensate for the amount of time he could not be with our son. During the day, he is with my ex's parents. I agree, I do not understand how this was seen as acceptable and I cannot believe this is what happened. Yes there was physical abuse. Yes, it was documented legally. Yes, there are witnesses. This is why the protection order was made permanent. Since then, he has violated the protection order 4 times. Yet still, the CFI continues to show a shocking bias toward him. I am now filing a grievance against the CFI and, I am seeking a new attorney.

She is still battling with her husband on the monetary support as she was a homemaker and dependent on her husband when she was married. The problem is with every court hearing, she needs to pay her legals fees which can cost S$10K per hearing. This case has been going on for 4 years already due to the different delay tactics which the husband uses with the hope of draining all her resources to prevent her from continuing with the case and she not getting any alimony payment. I Need Legal Advice: Marriage/Divorce? My friend is married and he and his wife are on the rocks, but that's irregardless to this question. Well, my friend (the married man) had about $87,900 saved in an account that he had in California.This money is money that he earned prior to the marriage due to the line of work he was in,as well as some money he received from serving as a Navy Seal.So, he had this money, it was HIS money, in his account, private, etc. His wife knew about it, though, of course. Well, she decided to TAKE that money and transfer it into an account for their newborn son (for his life, under his SSN) without asking the husband, and she will not give him access to the money now, because she opened the account on behalf of their baby using her name.So, basically, she stole it- even though they are married, etc.Is there any legal action that can be taken on the husband's part to get that money back, since she did not consult him first, and/or does he have any legal rights to gain access to the account?

My name is not actually on the business license but I have built it practically alone for 4 out of the 5 years it has been in operation. We are now considering divorce. Is this divorce legal and can I still fight it? Laws in Oregon require that a dissolution of marriage is legal if you have certain criteria. One of those is less then 15K in debt, Papers have to be served by a third party, and there cannot be any kids involved.. there are a few other things but I can't remember. Since we were 35k in debt, the papers were never given to me, and he lied to the judge to get her to sign the papers before the 90 day waiting period was up, does that mean our divorce is not legal and we are still married? Do you have any suggestions on what I can do? I don't want to be divorced. Legal advice? Anyone???

Legal advice about divorce...? I live in NC and I need help. Me and my husband separated almost a week ago. I know he is seeing an 18 year old girl (we are 24). We have a 3 year old son and I have told him over and over he is ruining his chances of seeing his son. This means no cohabitation. How much time does it takes in Florida or in Georgia? I understand that in some states, 2 years of separation grants you a divorce automaticaly. After a divorce,when minor children are involved, I need free legal advice on the fathers rights....? Is it legal for the custodial parent (mother) to use a fraudulant last name for their child in school and when registering their child in organizations such as dance classes,athletic leagues,church,pagaents etc. against the non-custodial parents wishes? HELP! I need legal advice regarding paternity and divorce!? I gave birth to a baby on March 15, 2007. I was legally married to my soon to be ex, but he is not the father of the baby. In the hospital, I was told that in the state of Michigan, the husband has to be on the birth certificate, even if he isn't the biological father. I want to have my husband removed from the birth certificate, and have no obligations in regards to child support, and then proceed with the divorce proceedings. I don't know where to start and I've contacted various agencies to find out and I keep getting the runaround. Do I establish paternity first? Or file for divorce first? If the baby's biological father won't submit to a paternity test, what are my options?? It's a big mess, I know. But my husband and I weren't together when I conceived with my ex-boyfriend. Now, the ex-bf is saying he won't have to pay child support because he's not on the birth certificate and he isn't responsible for anything to do with our son! My husband has been dishonest, bad tempered (sometimes physically/verbally abusive), etc. I don't love my husband anymore. I've been a stay-at-home mom for the last 8 1/2 years. My husband does not want a divorce and is still in denial about our unhappy marriage. He refused to go to marriage counseling for many years until now, now that it is too late! God knows I've tried to make it work. He wants us to sell our home but I will not do that. He's bitter and is not thinking how it will affect our boys. My children dont need to suffer more than they already will. I will do anything to keep my home, but the mortgage pymt is very high. I dont want to rely on him for financial support. step by step divorce advice please? My girlfriends husband is addicted to coccaine as I mentioned in passed questions. He was getting help but felll back into the drugs again. She wants to file for divorce but needs some info on how to handle this step by step. 1st she has 2 illnesses 1 is M.S. and the other it another blood disorder. Her insurance is through her husband. Next they have 1 child 1 1/2 years old also on his insurance. Next they own a house and the market is slow in her area now. They also have credit cards that totall about $20k. She only makes about $35k/year so no chance in keeping the home. So what can she do? He refuses to leave the house and she has no where to go and please don't say shelter or anything like that. Her husband isn't adusive or really causing much of a problem besides the fact that she hates him for doing drugs and not being there for her or the kid. The lawyer gave her legal advice like cost and time it would take but that doesn't guide her in the right direction. Advice please... She could get an apt. on her salary but the problem is owing a $2500 mortgage every month. Both of their names are on the house and he's not reliable enough to pay that. And she can't afford that on her salary alone. That's the problem. My advice was put her house for sale, find an apt. ask that her name be taken off the mortgage, hopefully the house sells soon enough, and then make the divorce final.
Divorces and legal advice? Just asking about some general information about a divorce agreement. Basically my wife and I came to an agreement. We both signed the papers and got divorced. Well I got the house, and now she feels like she got screwed. In reality I pretty much gave her more just so I could get the house without much of a fight. I personally don't feel my wife is all there and doesn't comprehend certain things. So even though the divorce may look slanted in her favor to someone unbiased she is so self centered she doesn't see things the same way. Basically I'm confident that the divorce was fair and if she fights it I will be ok. It's just the fact I want to put all this behind me and just move on with my life and not hire another lawyer.
