When I file for divorce is there any way I can avoid notifying my husband untill it is all over?

I am an over the road truck driver and so is he. He has said he is going to pay for it but it seems he can't get out of the red so rather than wait I am going to file as soon as I can save enough. I don't always know exactly where he is and I really would like to get this over without having to worry about giving him notice. He now uses his mom and dad's address but doesn't actually live there. There is no real property involved, no credit cards, and no children. I have caught up the rent without his help, all he is worried about is HIS van payments, which I want no part of and already told him he can have it as long as he takes his name off my truck lease. Other than that what we have as far as personal "junk" won't be argued over, he takes his and I keep mine,I don't want anything from him and vice versa.

  1. Understand your problem, but you can't just divorce somebody in secret. If you just do all the stuff you're worried about him doing (cleaning out the bank account and the house, for instance), he'll get the idea. Don't forget to turn off the credit cards and make sure they can't be re-opened. Talk to their fraud department to see how best to do that.

  9. I got a divorce by having it published in the newspaper. It takes a little longer, but if you don't have a current address you may have to try it. It has been 12 years, so I don't remember the details. I also had a lawyer handle most of it. Contact a lawyer for more recent information. Things may have changed since then.
  10. Nope...He HAS TO be served and aware that there is a court case against him. He will have to have a signature of the papers being delivered to him and on record before the courts will continue with the request for a divorce. You can have his mom and dad agree to accept the papers in his behave but you really need to ask a lawyer or a document service how that works. I think he would have to leave an notarized affidavit at his parents house saying he is out of state and aware of the divorce papers being served.

  12. Yes you can file just tell your lawyer that you do not know he is at and they will run it in the local newspaper and he has 30 days to answer if not you automatically get your divorce.
  13. You can't just divorce someone under YOUR terms. HE has the right to answer any and all charges in the divorce and the right to counter. He can be served via "snail mail" but you have to appoint someone to mail the forms to his last known address (that would be his parents), there is a form the person mailing the papers has to fill out that will go with the papers, you will also keep a copy and a copy will be filed with the court. There are laws concerning divorce and whether you want to or not you still have to follow them.
  14. You can get a divorce in the state of calif and maybe in others. I got mine in Calif by putting it in the local paper of his last know address. He had a certain amount of time to reply. He didn't, I got my divorce. And just to make sure it was legal, I did use a lawyer anyway although there was no property or anything except our 3 kids. I was also awarded full physical and legal custody of them. I asked for no child support on those conditions and again, since he didn't bother to show, I got all I asked for.
  15. Absolutely! All you have to do is pretend you do not know where they are and that they have abandoned you. Post notices in the local newspapers where he or his family won't see then wait. ( Your attorney can tell you this.) Many people win custody battles because the other parent wasn't notified, purposely so, and move to another state.   16. talk to a lawyer in ohio if they can't find the other party they run a notification in some little obscure news paper and the party has so many days to respond to it and if they don't then its called marital abandonment or somethig like that and you can get the divorce from them but instead of asking questions on here you need to ask someone who gets paid to do this kind of stuff just remember a slick talking lawyer can always find a leagle loop-hole around anything if you pay them enough money.

  21. yes there is , in some states all you need to do is place an ad in the local newspaper and if he does not read it he cant contest it and your divorce will be final.. good luck.
  22. In most states now there is "no fault divorce" especially for couples like you who have no property, children, etc. You can even do it yourself. File it , put an ad in the paper, after a certain time, you have your divorce. You can get the paperwork from the local courts or in major book stores.

Most of the time the lawyer will send a copy of the divorce papers that are being filed in court to the last known address. These are usually sent registered mail, return receipt. If the person doesn't pick up and sign for the mail it goes back to the attorney and he can proceed with the divorce. Everything depends on the state you live in. You can also do your own divorce since you have no personal property, no debt, and no children. Do a goggle search for divorce in your state. You just might get this all done for $200.00.
  25. i do not know what state you are filing in but from experiance in michigan, you have to in alll states requier you to notify the other person but in michigan you can file now and see if you qualify to have the amount due turned it at a later time or were there is a reduced fee or free i would find away to get a signeture form him. there are other lopes like posting an add in the news papers (the ones around were he is) and if he does not answer the add. there are books at the book store normaly on how to do it yourself divorce book. i used it they are great and easy. all i got to say is my ex is in the Navy and was over seas when i filed and he did not want to sign but i did get the divorce so do not lose hope or faith. also there is/should be a space were you can get your devorce to read any property in your posetion is yours and the same way with his. hope this is a help good luck.

  27. No, you cannot. Every legal action, of which divorce is one, requires Legal Service of process be filed on the oppossing party. If you don't know how to get in touch with him then there are procedures to follow which allow service by publication. however, if you can prove to the court that his mother and father's address is also being used by him, then with the court's permission, you may be able to serve him by registered mail at that address.

  29. I would see my lawyer and get the ball rolling. You have his legal address where the rest of his mail is sent and that should be sufficient. His parents will get in touch with him when they see a letter from the lawyer/court. Just make sure any credit cards or other bills that have your name on them are closed and let the creditors know that you will not be responsible for any charges made. Let your lawyer handle this.   30. U need to file by divorce by publication....its where they print it in the newspaper for 6 months and if he doesnt respond by then u have to appear in court one more time after that and ur divorce should e final ....unless u want child support or maintaince. then you have to notify him.
  31. Get a lawyer and he can take care of any contacting him. Either break the lease on your truck, or have the lawyer draw up an agreement stating if he doesn't take his name off within like 30 days, the truck becomes 100% yours regardless of whose names are on it.

  33. In Alabama you can serve the other party by publication in a newspaper that is circulated in the county which you live, if you don't know the whereabouts of your spouse. It wouldn't be final before he heard about it though.
  34. Call your local courthouse. Here in the county I live in in PA you can go to the courthouse and pick up the divorce pack of papers. You fill it out, send it back with 120 bucks. They do what they have to, and keep the original. They send you a certified copy (for your spouse) and a copy for you. You can either present the spouse with his copy or send it certified mail. Once the courthouse has the papers back you have 90 days from then and the divorce is final. It's a little easier being that there are no kids involved. Good luck.
  35. You will need a lawyer. That goes without saying. All of your questions can be answered by the lawyer. As far as your husband having an address but not using it - well, his parents will just have to get in touch with him somehow and you don't need to deal with them. People can try to run away but it's very difficult to play games with the law and stay underground because you don't want to deal with things. A lawyer should explain this to you.
