Divorce Tips Please!!?
My husband and I have been separated for over a year. I just moved and found out that I cannot file for the divorce which we both decided was the best option for ANOTHER WHOLE YEAR. I have asked him over and over to file it where he lives, even going so far as to offer to pay half the costs, like a responsible person should. The only reply he's given me is to curse at me and call me a line of insulting names. I've tried calling Legal Aid in both our states and they won't help unless he had physically abused me, which he hadn't. (He did everything except hit me.) I need help. Advice, tips, pointers. I've never been through a divorce before, and never had this kind of thing happen to me. I want to divorce this man so bad, and it seems like all he wants to do is call me a whore and hang up on me. This is in reference to a divorce which must occur between a resident of Kentucky and a resident of South Carolina. My husband and I have been separated for over a year. Further information I should note: I make less than $400.00 a month. There is really no way I can afford to eat *and* pay for this divorce myself through most lawyers. :( Which is why I went to legal aid for help and was rejected because he didn't physically abuse me.

- You can file for divoce anytime you want. It takes a while for the divorce to be final as most states have a cooling off period of 90 days or longer. You need to have grounds for divorce if he is unwilling to agree to it. Adultery, abandonment, physical abuse and things like that can be legal grounds to force a divorce even if he won't consent. You are getting misinformation from misinformed people. You should speak to your husband in non-emotional terms. Don't call him names. Just tell him what you want and what you intend to do. Then do it. Do NOT lose your cool. Be as business like as possible ... wear your best poker face.
- You need to get the advice of a lawyer - especially since there are multiple state laws involved. Your best and fastest way to a divorce is a lawyer - it might cost you more money but if you want it done fast and right it's probably your best bet.
- tape a few phone calls where he's calling you a whore and whatever else..take it to legal aid and tell them abuse isn't only physical...see what happens?
- The husband usually is ordered to pay the wifes lawyer if she wins the divorce. I had to pay my wifes lawyer.
- I'm a family law attorney. I don't know the procedures in your state, however. First, you might be able to file for legal separation now, and convert it into divorce. Second, you could go to Nevada, where you could be divorced in six weeks (including the alleged residency period).
- It truly depends on your State laws. Where I reside you have to be legally separated for one year, if you have children and six months if no children, before you can obtain a divorce. Also, during the separation period there can be no co-habitation between the spouses. So, if you were living together this past year, that is probably why you have to wait another year.
